The article studies a dataset of interviews conducted with Western Australian police officers, to identify what factors police consider when deciding whether to issue a criminal infringement notice (penalty notice) for minor offences. The article argues that police officers’ choices about how they use their discretion can reinforce an unequal justice system that treats some people as deserving of leniency (through an infringement notice), while treating the most disadvantaged members of society as not deserving.
