This is Chief Justice Forbes' judgment in R v Johnston, Clarke, etc [1824] NSWSC 8 in which he sets out his reasons for acquitting five white men for the manslaughter of an Aboriginal woman. This case concerned what is known as the 8-mile Swamp Massacre in which three Aboriginal women were killed near Bathurst.
