Since 1865, fisheries laws in NSW have regulated fishing with limited recognition of Aboriginal fishing practices, rights and interests. Despite more recent laws that aim to recognise these rights, the government has continued to criminalise Aboriginal cultural fishing.

Laws have recognised the native title rights and interests of Aboriginal people in NSW including hunting, fishing, and gathering rights. These laws aim to allow Aboriginal people to continue to practice their way of life and exercise rights to country and resources.

From 1879, laws set aside areas of land as National Parks. They did not include provisions for the involvement of Aboriginal people in their management.  In recent decades, laws and policies have introduced mechanisms that facilitate Aboriginal people’s ownership and co-management of some National Parks.
